The future of daily fantasy sports in New York is uncertain after the state Supreme Court ruled the games are gambling and violate the state’s constitution, the Rochester Democrat and Chronicle reported.
State Supreme Court Justice Gerald Connolly ruled the state’s 2016 law that allows fantasy sports violates the constitution’s gambling ban but said legislators can act to take daily fantasy sports out of the penal code.
DFS operators say the contests are games of skill, not gambling.
The state is reviewing the ruling. If it appeals the decision, DFS operators such as DraftKings and FanDuel will likely be able to continue operations during the process.
