The state first filed a lawsuit in 2008 to take over more than 140 gambling websites, saying the companies were operating illegally in Kentucky. In 2011, Maryland and New York brought similar actions to federal court, which Kentucky joined. The payout comes from the combination of these federal lawsuits against PokerStars and Full Tilt Poker.

The original 2008 lawsuit is still ongoing. Kentucky officials said that the state will continue to target online gambling websites operating illegally in the state.
